Privacy Statement and Consent to Data Processing by Lensvision AG

Data protection is a matter of trust and to us, your trust is important. We respect your privacy and personal space. Therefore, the protection and lawful collection, processing, and use of your personal data is an important matter to us. So that you feel safe when visiting our websites, we strictly observe the statutory regulations when processing your personal data and here we would like to inform you about how we collect and use data.
This privacy statement is an integral part of the terms and conditions of LENSVISION AG. By accepting the terms and conditions, this privacy statement will also be understood to have been accepted. We reserve the right to make changes to these terms and conditions. The respective applicable privacy statement can be found in the footer under the “Privacy statement” link, where it can be printed, downloaded and saved. You can print or save the respective applicable version by using the usual function of your internet service program (=Browser: usually “File” -> “Save as”).

3. Collection of Personal Details and Use of Data
You can visit the LENSVISION website at any time without disclosing your personal details.
When visiting our website, our servers temporarily save each access in a log file. The following data will be collected without your input and stored by us for a maximum of twelve months, until it is deleted automatically:
- the IP address of the inquiring computer
- the date and time the website was accessed
- the name and URL of the requested file
- the website from which our website was accessed
- the operating system of your computer and the browser used
- the country you are accessing from
- the name of your internet access provider
The collection and processing of these details will be carried out for the purpose of enabling the use of our website (establishing a connection), guaranteeing permanent system safety and stability, and enabling our internet offer to be optimised, as well as for statistical purposes. The IP addresses will only be analysed when the network infrastructure of lensvision.ch is attacked and for statistical purposes.
We collect, save and process personal details solely in accordance with the statutory regulations and only when it is necessary to do so for the fulfilment of the contractual obligations between us and the user, or to supply the products on our websites. This also includes the storage of data for any warranty claims once the contract has been fulfilled.
We will also use your details within the framework of the applicable law for our own marketing purposes, to optimise our online offer, make your shopping experience with us more comfortable and individual, and to make customers aware of products that may be of special interest to them.
Moreover, personal details are only collected, processed or used provided that you have given your consent.
Personal details are indications of factual or personal circumstances of an identified or identifiable person and enable their identity to be traced. This includes, for example, your name, telephone number, address, and inventory data you share when you register and create your customer account.
Your personal details will be deleted provided that there are no statutory obligations to archive them and you make a request for them to be deleted, if the data is no longer required for the purpose for which it was stored, or if it may not be stored for any other legal reasons.
4. Use of Your Data for Marketing Purposes
a) Sending of newsletters
When subscribing to the newsletter, your email address will be used for advertising purposes respectively customer specific advertisements at Lensvision or at selected partner shops (see www.lensvision.ch/partner-shops), until you unsubscribe from the newsletter. You can unsubscribe at any time. We are entitled to assign third parties with the technological handling of advertising activities and have the right to pass on your details for this purpose.
b) Service and product information
When we receive your email address during an order placement for goods at our web shop, we will use your email address to inform you via service and product information emails about similar products that may be of interest to you. However, we will only use your email address for this purpose if you have not disagreed to us doing so. You can disagree at any time.
c) Customer account
For every customer that registers accordingly, we will enable password-protected, direct access to their order details that are stored by us (customer account). Here, you can see details about completed, open and recently dispatched orders, and manage details. You agree to treat personal details confidentially and to not make them accessible to unauthorised persons. We cannot assume any liability for the improper use of passwords, unless we are at fault.
5. Passing on of Information to Third Parties
We disclose your personally identifiable information only, if you have expressly consented, if there is a legal obligation for us to do so, or if it is necessary to enforce our rights, in particular for the enforcement of claims arising from the contractual relationship. In addition, we disclose your data to third parties, insofar as this is necessary prior to the conclusion of a contract or for reasons of implementing a contract. For these purposes, we disclose the data needed to any subsidiaries, transport companies, and other service providers. These service providers use your data, in particular to prepare themselves, if necessary, prior to the conclusion of the contract, as well as to implement a corresponding order, but not for any other purposes.
We also use the services of external service providers who help us provide you with a better customer experience (see also Item 10, Tracking Tools).
6. Transfer of Personal Details Abroad
LENSVISION is entitled to pass on your personal details to third party companies abroad, provided that this is necessary for the execution of the contract, or that this takes place within the framework of the tracking and targeting measures mentioned in Item 10. These are subject to data protection to the same extent as the provider. If the level of data protection in a country is not the same as in Switzerland, we will contractually ensure that your personal details will be protected to the same extent as they are in Switzerland.
7. Encryption of Sensitive Data
We will protect your data transfer by means of a secure SSL connection. SSL (SSL encryption) is a security technology that ensures that your personal details, including credit card details, login details, and your preferred payment method, are transferred safely over the internet. The data is encrypted so that it can only be read by the payment system.
8. Credit Assessment
If we provide a service in advance, for example in the case of a purchase on account, we will obtain a credit report from a credit agency based on mathematical and statistical processes in order to protect our legitimate interests, if necessary. For this, we will provide a credit agency with the personal details required for a credit check and we will use the information we receive about the statistical probability of a payment default in order to make a decision for the drafting, execution or termination of a contractual relationship. The credit report can include probability values (score values) that are calculated based on recognised mathematical and statistical processes and incorporate address details, amongst others, during the calculation. Your legitimate interests will be considered in accordance with statutory regulations.
Cookies are files that your web browser automatically stores on your computer’s hard drive when you visit our website. Cookies help in many ways to make your visit to our website easier, more enjoyable and more useful.
Cookies do not harm the hard drive of your computer, nor are the user’s personal details passed on to us.

For our website and the web shop, we use Google Analytics and Google Remarketing, both of which are website analysis services of Google Inc. (“Google”). Google uses co-called “cookies”, which are text files that are stored on the user’s computer and enable their use of the website to be analysed. Information collected by the cookie about the use of this website by its users is generally transferred to a Google server in the USA and stored there.
On behalf of the operator of this website, Google will use this information to analyse the use of the website, create reports about website activities and provide the website operator with further services related to website and internet use.
Your browser IP address passed on by Google Analytics will not be combined with other Google data. The user can prevent the storage of cookies by configuring their browser software accordingly; however, this offer informs the user that in this case they may not be able to use all functions of this website to their full extent. Our sites use functions of Google +1, the provider of which is Google Inc. 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. With the aid of the Google +1 button, you can publish information worldwide. Via the Google +1 button, you and other users will receive personalised content from Google and our partners. Google stores both the information that you have given to +1 for content, and information about the site that you have looked at by clicking on +1. Functions of the Instagram service are incorporated into our websites. These functions are provided by Instagram Inc., 1601 Willow Road, Menlo Park, CA, 94025, USA. If you are logged into your Instagram account, you can link the content of our sites with your Instagram profile by clicking on the Instagram button. Instagram will therefore be able to match the visit to our website to your account. We would like to point out that as site providers, we do not receive any information about the data transferred or its use by Instagram. On our site, we use social plugins from social network Pinterest, which is operated by Pinterest Inc., 635 High Street, Palo Alto, CA, 94301, USA (“Pinterest”). When you visit a site that contains such a plugin, your browser will make a direct connection to the Pinterest servers. The plugin will transfer log files to the Pinterest server in the USA. These log files may contain your IP address, the addresses of websites visited that also contain Pinterest functions, the type and configuration of the browser, your method of using Pinterest and cookies. 12. Facebook Conversion Pixel
We use the “conversion pixel“ of Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”). This enables us to follow the activities of users after they have seen or clicked on a Facebook advert. In doing so, we can assess the effectiveness of the Facebook adverts for statistical and market research purposes. Data collected this way is anonymous; in other words, we do not see the personal details of individual users. However, these details will be stored and processed by Facebook and we will inform you of this according to our level of knowledge. Facebook may link this data to your Facebook account and use it for their own advertising purposes, in accordance with Facebook’s data use guidelines https://www.facebook.com/about/privacy. You can enable adverts from Facebook and their partners to be displayed on and outside of Facebook. Moreover, a cookie can be stored on your computer for this purpose. If you do not wish for this to happen, you can disable cookies in your browser settings.
13. Right to Disclosure, Deletion and Correction
Customers can request to view personal details about them that are stored by LENSVISION or view these and change them themselves by logging into the website. They have the right to view, correct, block, and delete the details about them that are stored at any time. A deletion of the data can be requested at any time, provided that there are no statutory regulations stipulating that it must be stored. Access to the data must be requested in writing and together with a copy of the identification papers of the person making the request. This can be made either by mail or email to email@example.com. We would like to point out that in case your details are deleted, the use of our services will not be possible or will not be possible to its full extent.
Please note that statutory retention periods apply for certain data. This data must be stored by us until the period has expired. We will lock the data in our system and only use it for the fulfilment of legal obligations.

By registering or using the website and the web shop of LENSVISION, customers declare their consent to the collection, storage and use of their personal details to the extent described above. You may withdraw this consent at any time with future effect.
